Conditions of Booking |
Curlew
Cottages (the “Agent”) acts as booking agent
on behalf of the homeowner. Once
the holiday confirmation is issued, the contract is between
you, the holidaymaker and
the owner of the holiday home.
- The booking form can be sent by fax
or email and a reservation will be held for 5
days. The booking form must
then be sent by post with a deposit of 30% of the cost of the holiday plus the
Holiday Cancellation Insurance (not compulsory). Upon acceptance of the booking,
the balance of the rent must be paid 6 weeks before the holiday. If booking 8
weeks or less before the commencement of the holiday, the full amount of the
rental plus Cancellation Insurance must be paid at the time of booking. Any applicable
VAT is included.
- If the balance of the rent is not
paid by the due date, the Agent on behalf of
the Owner shall be entitled to cancel the reservation
and the holidaymaker will forfeit the deposit.
If the holidaymaker wishes to cancel the reservation
he/she must advise the Agent in writing and the full
amount of any balance due must be paid to the Agent
by the
due date. If the property is not relet for the period
reserved no refund will be made. If the property
is relet then
the Agent will refund the total rental to the holidaymaker
less £20 for administration costs. (The
Cancellation Insurance will usually cover this liability).
- You, the holidaymaker must agree
to keep the property clean and tidy and leave
it in the same condition as at the
commencement of holiday. In addition, you will compensate
the Owner for damage or breakages incurred or
excess cleaning required.
- If the holidaymaker considers he/she
has cause for complaint, the matter must be taken
up immediately with the Owner/Keyholder of the
property. If satisfaction cannot be obtained,
then the holidaymaker must then report the
matter to the Agent who will make a full investigation.
Under no circumstances will the Agent accept claims
for
compensation lodged after departure as it is no longer
possible to investigate the complaint in order to
take
corrective action.
- Except by prior arrangement no more
than the stated number of persons may occupy
the property and the Owner/Keyholder has the right to
refuse to admit more than the number of persons shown
on the booking confirmation. Some Owners do not allow
small children and pets and these conditions must be strictly
adhered to.
- Bed linen is normally included unless
otherwise stated and if a cot/high chair is required,
these items must be requested at the time of booking.
- You, the holidaymaker agree to abide
by the dates agreed for your holiday i.e. from 3pm on
the day of arrival (unless
a specific time is requested)
until 10am on the date of departure.
- The Owner of the property or his/her
representative shall be allowed any reasonable access
to the property during
the holiday period by appointment except in case
of emergency.
- Whilst every effort is made to ensure
the accuracy of the details in the Brochure, the Owner
and the Agent shall not be held responsible for any mistakes
or changes beyond their control.
- The Agent gives no warranty as to
the state and/or condition of the property or
any changes made by the Owner without informing
the Agent. Nor shall the Agent be liable for
any act or neglect or default on the part of the
Owner or for any loss, damage, expense, accident,
injury or inconvenience whether to persons or to
property
which the holidaymaker or any member of his party
or any other person may suffer or sustain arising
out of or in
respect of the reservation or otherwise howsoever
caused.
- The Agent cannot accept liability
for happenings outside its reasonable control,
such as breakdown of domestic appliances, plumbing, wiring,
temporary invasion of pests, annoyance through local flora
and fauna, damage
resulting from exceptional weather conditions or
the owner’s negligence resulting in loss, injury
or accident.
- The Agent is not liable for any claim
for compensation from the holidaymaker in respect
of any booking not honoured by the owner or deterioration
in the condition of the property as advertised
by the Agent in good faith.
Any claim MUST be directed to the owner.
